Booking and Payments

Reservations: All bookings with Sunny Jeeps must be confirmed by the appropriate online booking methods. An online reservation ticket will be issued. On the day bookings can be accepted subject to availability. Either call or email Sunny Jeeps if booking is for the same day.

Payment: Full payment for the tour must be made at time of booking. Payment methods include credit card, debit card, and bank transfer.

Optional Extras: All optional extras are subject to availability at the time of booking. It is deemed that by purchasing our optional extras, our customers have accepted the terms and conditions associated with the optional extras purchased. This will be shared specific to each booking.
Changes and Cancellations

Amendments by Sunny Jeeps: Sunny Jeeps reserves the right to make necessary changes to the tour itinerary at any time due to unforeseen circumstances such as weather or tide conditions or safety concerns. In such cases, we will provide an alternative tour or a full refund.

Customer Requests for Changes: Customers may request changes to their booking date up to 7 days before the tour date. We will do our best to accommodate these requests but cannot guarantee that all changes will be possible.

Cancellations by Customer: Cancellations made more than 2 days before the tour will receive a full refund. Cancellations made within 2 days of the tour will not be eligible.
Safety and Conduct

Safety Compliance: All participants must adhere to the safety instructions provided by Sunny Jeeps staff. Failure to comply with safety guidelines may result in removal from the tour without a refund.

Behaviour: Customers are expected to behave in a respectful manner towards both staff and fellow participants. Any behaviour deemed inappropriate by Sunny Jeeps staff may result in removal from the tour.
Liability

Personal Belongings: Sunny Jeeps is not responsible for any loss or damage to personal belongings during the tour. We advise customers to take necessary precautions to safeguard their valuables.

Assumption of Risk: By participating in a Sunny Jeeps tour, customers acknowledge and accept the inherent risks associated with off-road and beach driving. Sunny Jeeps or any of its employees is not liable for any injuries or accidents that occur during the tour, except in cases of gross negligence or wilful misconduct by our staff.

Cancellations: Occasionally unforeseen circumstances, including (but not limited to) adverse weather conditions, pandemics, industrial actions, civil unrest, mechanic faults, or insufficient passenger numbers, require us to alter routes, itineraries, vehicle types, fares, days of operation or even cancel journeys. We retain the right to do any of these things without notice (however, where practical we will endeavour to provide you with notice of alterations or cancellations).
Insurance

Travel Insurance: It is highly recommended that all participants obtain travel insurance. This should include coverage for medical expenses, personal injury, and trip cancellations.
Pandemic Policy

Acknowledgement: You acknowledge and agree that it is your responsibility to follow and observe all directions by Queensland Health and requirements Sunny Jeeps puts in place to maintain health and safety on our journeys, and that we have no liability for any failure to do so.

Health and Safety: You acknowledge and agree that, despite measures and actions taken to maintain health and safety on our journeys, we are unable to prevent or avoid all risks relating to COVID-19 or any other pandemic on our journeys and you accept personal responsibility and liability for any and all risks relating to COVID-19 or any pandemic while on our journeys.

Changes to Policy: We retain the right, acting reasonably, to vary these Terms and Conditions from time to time to further respond to COVID-19 or any type of pandemic and its impact on the operations of our journeys and the health and safety of customers on our journeys. Any variations become effective on posting of the changes on the website and we encourage users to access and review this document regularly to keep informed of such changes.
Miscellaneous

Age Restrictions: For safety reasons, participation in the tour is restricted to children aged 7 years and older. Please email Sunny Jeeps at contact@sunnyjeeps.com.au to add a child seat/s to your booking. Note: this could restrict the numbers able to travel so customers should check in advance before making any payment.

Health Requirements: It is your responsibility to ensure that you are physically able and fit enough to participate in our journeys. If you have any questions about fitness levels and physical abilities required, please ask us before you book a journey. By booking a journey with us you represent to us that you are physically fit and able to participate in the journey with us and there are no health-related reasons or problems that will preclude your participation in the journey. Sunny Jeeps reserve the right to deny participation to anyone deemed unfit for the tour.

Photos and Videos: Sunny Jeeps may take photos and videos during the tour for promotional purposes. By participating, customers agree to allow the use of these images for marketing and promotional activities.

Pickups: You must be waiting at the designated pick-up location at least 10 minutes before the designated pick-up time of the journey. It is your responsibility to ensure that you are visible to the Sunny Jeeps driver. If a Sunny Jeeps driver is not easily able to locate you at the designated pick-up location at the designated pick-up time, we reserve the right to depart without you and you will be deemed to have cancelled your booking resulting in a full fare forfeiture.

Luggage Limits: There is limited luggage storage available on our journeys. Please do not bring excessive luggage with you. Each person is permitted to bring one small backpack or handbag and one medium-sized bag. Excessive luggage may be stored with your accommodation provider. Any inappropriate luggage presented on the departure day may result in refusal to board.
Rights and Obligations
Tour Guide and Drivers Rights: You acknowledge and agree that our tour guides and drivers must comply with the relevant bus driver fatigue management requirements applicable to the State or Territory where the services are delivered.
Our drivers have the right to refuse passengers who:

are under the influence of alcohol or drugs;

are likely to become objectionable to other passengers;

are observed smoking, vaping or attempting to smoke/vape on board the vehicle
-
fail to comply with any applicable laws, rules and regulations;
Terminate the Tour: The tour guide can immediately cancel the tour for any of the above reasons without any liability in the event of unsociable or unruly behaviour which affects the tour or the environment or any other vehicle or person
Your Obligations:
At all times, remain responsible for the acts of all passengers during the delivery of the tour, transfer or charter services;
You acknowledge that:

You will allocate a safe and legal pickup point for the tour and must not load the vehicle beyond capacity.

Smoking is not permitted by law.

Consumption of hot food, alcohol and illegal drugs is not allowed on our transport.

You are responsible for all personal items. We do not accept any responsibility for any damage to, theft or loss of any personal belongings.

Registered service animals only are permitted to travel with their owner.
Recreational Activities
Participants Responsibility

All participant(s) agree to stay on the tracks, routes, roads and areas instructed by Sunny Jeeps. The participant(s) understand, accept and approve that Sunny Jeeps can reclaim any costs of fines or loss of licenses incurred by the participant(s) disregard of these instructions.

Participants must not participate in any activity if they have any injury, disability, medical or health condition that may increase them in becoming injured unless Sunny Jeeps has been made aware of it and given written consent for the customer to participate.

Sunny Jeeps reserves the right to stop participant(s) from partaking in activities if they do not show sufficient skill and experience or for any reason that safety of themselves or other participants could be put at greater risk.
RISK WARNING: Recreational Activities including but not limited to bushwalking, hiking, kayaking, and surfing involve significant risk of physical harm, including personal injury, permanent disability and/or even death. Such harm may result from your own actions, or the actions and/or omissions of others.
Activity Safety and Liability Waiver
Sunny Jeeps will do our utmost to provide you with accurate information at all times to ensure your safety during your participation in activities on our journeys. However, because there are events that may occur that are beyond our control, it is also necessary for you to be clear that your safety is primarily your responsibility and that you undertake these activities with full awareness of this fact.

Where Sunny Jeeps utilises 3rd party equipment and facilities for any additional activities, it is the participants responsibility to follow the Terms and Conditions for those 3rd parties. We claim the right to gain your agreement to a waiver in respect of our responsibilities in facilitating those additional activities through Sunny Jeeps.

Participants understand and accept personal responsibility for any and all risks associated with outdoor activities, with a person or persons engaged by Sunny Jeeps.

This release and indemnity continues forever and binds participants’ heirs, successors, executors, personal representatives and assigns.

It is the responsibility of the individual making the group booking to ensure each member of their group is aware of all Terms and Conditions of participating in a Sunny Jeeps activity and/or journey.
